Case No. 29 of 2025 for the offence registered under Sections 64(2)(m), 65(1) of Bhartiya Nyaya Sanhita, 2023 and Section 4/6 of the POCSO Act pending in the Court of learned Special Judge, POCSO Court, Garhwa, is pressed into motion. Informant is the victim girl and as per the FIR, physical relationship was established by the petitioner on a false promise of marriage. It is submitted by the learned counsel on behalf of petitioner that the case has been registered on 11.05.2025, whereas the offence was allegedly committed in March, 2021. It is alleged that the physical relationship was continued on a false promise of marriage and compromising pictures of the victim with the petitioner was uploaded on social media. However, there is no evidence or even relevant Sections of the IPC to make out an offence under Information Technology Act, 2005. At the time when the case was lodged, the victim has given her age to be 20 years. Learned A.P.P. opposed the bail petition. There is delay in lodging the FIR by about five years. Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
