Petitioner has filed this writ petition seeking following reliefs:- ‘10.1 Hon’ble Court may kindly be pleased to call for the entire record in respect of case of husband of petitioner. 10.2 Hon’ble Court may kindly be pleased to direct respondent authority to pay the gratuity amount to the petitioner with 18% interest. 10.3 Any other relief may also be granted to the petitioner, which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case.” 2. Learned Counsel for the petitioner submits that the husband of petitioner died in harness on 04.10.2017. After death of husband of petitioner she became entitled for death cum retiral dues. Amount of gratuity is not paid to petitioner till date. Petitioner has already submitted representation which till date is pending consideration and, therefore, direction be issued to concerned respondent authority to consider and take decision on pending representation at the earliest within specified time frame. 3 / 3 3. Learned counsel for State submits that in view of submission made by learned counsel for petitioner for taking decision on representation submitted by petitioner, he is having no objection. 4. On due consideration of submission made by learned counsel for the respective parties and nature of grievances raised in this writ petition with regard to non-payment of gratuity of petitioner’s husband, I find it appropriate to dispose of this writ petition at this stage directing respondent no. 2, 3 and 4 to consider and take decision on representation submitted by petitioner and accordingly, make payment of gratuity amount if due to petitioner, in accordance with law, expeditiously, preferably within a further period of 04 weeks from the date of receipt of Order 5.
