The petitioner is seeking pre-arrest bail in connection with Baideswar P.S. Case No.03 of 2026 corresponding to G.R. Case No.11 of 2026 registered for the alleged commission of the offences punishable under Sections 331(4)/305(a) of the BNS, 2023, pending in the Court of the learned S.D.J.M., Banki. 3. Learned counsel for the petitioner, on instruction from the petitioner, submits that except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R. p. 2 4. Learned counsel for the petitioner draws my attention to the order dated 20.01.2026 passed by the S.D.J.M., Banki in G.R. Case No.11 of 2026 in which Alok Rout and Lalaji @ Lala Dalai have been admitted to regular bail. In view of the development in the interregnum the learned counsel on instruction submits that instead of pressing this application the petitioner would surrender before the court below, but their application may be directed to be decided on the same day. The petitioner seeks parity with the co- accused persons. 5. Regard being had to the aforementioned submission made by learned counsel for the petitioner, although I am not inclined to entertain the present bail application, however, the petitioner is at liberty to surrender before the trial Court on or before 20.05.2026 and move regular bail application urging all the grounds as has been urged in the present petition including the ground of parity. If such bail application is moved by the petitioner before the trial Court, the p. 3 same shall be considered on its merit in accordance with law on the same day. 6.
