Sahoo, ASC CORAM: JUSTICE BIRAJA PRASANNA SATAPATHY Order No. ORDER 23.04.2026 01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode. 2. Heard learned counsel appearing for the Parties. 3. The present Writ Petition has been filed inter alia with the following prayer:- “In view of the circumstances of the case the petitioner prays Your Lordships may graciously be pleased to: a) set aside the impugned order dated 05.04.2026 (Annexure-1); b) direct the Opp. Parties to supply all relevant documents requested by the Petitioner under ANNEXURE- 10 for effective defence; And/ Or may pass any other Order / Orders, Direction/Directions as your lordships deem just and fit. And for which act of your kindness the petitioner as in duty bound shall ever pray.” 4. It is contended that when two proceedings were initiated against the Petitioner on 20.02.2026 under Annexure-6-Series, Petitioner made an application to provide him the documents, so that he can file his reply in both the proceedings under Annexure-10 dtd.01.04.2026. But such prayer of the Petitioner was rejected on the ground that, since in the application so filed, Petitioner has not given the details of the documents that he desires to file his reply, the application is not entertainable. 4.1. Learned counsel appearing for the Petitioner contended that taking into account the ground of rejection, he may be permitted to make a fresh application by giving the details of the documents, he wants for filing of the reply in both the proceedings before Opposite Party No.3 and Opposite Party No.3 be directed to provide the documents. 5. Learned Addl. Standing Counsel for the State has no serious objection to the course of action proposed. 6. Having heard learned counsel appearing for the Parties and considering the submissions made, this Court while disposing the Writ Petition with quashing of the impugned order dtd.05.04.2026 under Annexure-1 permits the Petitioner to make a fresh application, specifying the documents he desire to file his reply in both the proceedings by 01.05.2026. On such filing of the application, Opposite Party No.3 shall consider the same and provide all the documents which are required for filing of the reply, latest by 15.05.2026. Till the documents are provided as directed, no enquiry be conducted in both the proceedings. 7. Accordingly, the Writ Petition stands disposed of. (Biraja Prasanna Satapathy) Judge Subrat
