CRL.REV.P.(MAT.) 153/2026, CRL.M.A. 8717/2026 (for additional documents), CRL.M.A. 8718/2026 (for ad-interim ex-parte stay) By way of the present petition filed under section 438 read with sections 442 and 528 of the Bharatiya Nagarik Suraksha Sanhita 2023 (‘BNSS’), the petitioner seeks setting-aside of order dated 12.12.2025 passed by the learned Family Court-II, West District, Tis Hazari, Delhi (‘family court’) in Mt. No. 645/2017, whereby the learned family court has awarded ad-interim maintenance of Rs.35,000/- per month to the respondent from the date of the filing of the application. The petition under section 125 of the Code of Criminal Procedure, 1973 (‘Cr.P.C.’) is still pending consideration before the learned trial court; and is listed next for recording of evidence of the parties. Needless to add, that the petitioner shall be at liberty to canvass all the grounds for opposing the petition under section 125 of the Cr.P.C. before the learned family court, as may be permissible in accordance with law.
