Learned advocate for the petitioner submits that the petitioner is in custody for more than nine months and till date charges have not been framed. Learned advocate for the State submits that from the house of the present petitioner more than 300 gm of heroine were recovered and some of the accused persons are still absconding. Having considered the quantum of seizure, I am of the view that, at this stage, it would not be fit and proper to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected.
2 However, the petitioner would be at liberty to renew his prayer for bail after the evidence of the seizure list witnesses is over. Learned trial court, if required, would split up the trial of the case. Accordingly, CRM(NDPS) 302 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
