The petitioners are apprehending their arrest in connection with Rikhiya P.S. Case No. 01 of 2026 for the alleged offences registered under Sections 109(1), 115(2), 126(2), 118(1), 352 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned J.M. 1st Class, Deoghar. 3. Learned counsel appearing for the petitioners submits that there is a land dispute between the parties and there are case and counter case. He further submits that the there are general and omnibus allegations of assault and in view of that the anticipatory bail may kindly be granted to the petitioners. 2026:JHHC:10367 --2-- A.B.A. No. 1528 of 2026 4. Learned counsel appearing for the State opposed the prayer and submits that allegations of assault are there against the petitioners and in view of that the anticipatory bail may kindly be rejected. 5. On perusal of the FIR, it transpires that there is a direct allegation of assault upon the petitioner no. 1, namely, Maheshwar Mandal and pursuant to that grievous injury has been received by the father of the informant and in view of that, I am not inclined to grant the anticipatory bail to the petitioner No. 1, namely, Maheshwar Mandal. Accordingly, prayer for anticipatory bail of petitioner No. 1, namely, Maheshwar Mandal is hereby rejected. 6. So far petitioner No.2, namely, Rajendra Mandal and petitioner No.3, namely, Shambhu Mandal are concerned there are general and omnibus allegations against them. It has been pointed out that there is land dispute between the parties and in view of that the petitioner No.2, namely, Rajendra Mandal and petitioner No.3, namely, Shambhu Mandal are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner Nos.2 & 3, above named, on such terms and conditions or the sureties as the learned Court may deem fit and proper.
