The petitioners are apprehending their arrest in connection with Dhansar P.S. Case No. 236 of 2025, registered for the offence under Sections 115(2), 117(2), 109(1) and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Dhanbad. 3. Learned counsel appearing for the petitioners submits that for construction, petitioner no.3 has unloaded Asbestos and for space, the altercation took place. He further submits that there are case and counter case between the parties. He next submits that although injury has been received, but the allegation of assault is there against all the petitioners which are general and omnibus. He also submits that the petitioners have got no criminal antecedent as disclosed in para 14 of the petition. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are thereof assault and injury has been also been received by the informant. 5. Considering that there are case and counter case between the parties and the altercation took place due to space where Asbestos has been kept by petitioner no.3 and the petitioners have got no criminal antecedent as disclosed in para 14 of the petition and in that view of the matter, the petitioners, named above, are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
