Petitioner has filed the present writ petition seeking a direction to the respondents to consider the transfer of the petitioner as per the provisions of Section 17(1)([k)(4) of the Uttarakhand Annual Transfer Act for Public Servants, 2017 (for short, “the Transfer Act, 2017”), pursuant to the application moved by the petitioner in the prescribed format on 22.09.2025, annexure-6 to the writ petition.

Learned counsel for the petitioner contends that the petitioner is working as an Assistant Teacher at Government Model Primary School, Shama Panyali, District Bageshwar. The husband of the petitioner is working in the Animal Husbandry Department and is presently posted at Lalkuan, District Nainital. Under the spouse policy and relying upon the provisions of the Transfer Act, 2017, petitioner sought her transfer from District Bageshwar to District Nainital. He further submits that petitioner’s representation has been pending since 2025 and petitioner wants the said representation
2026:UHC:4635 2 to be decided by the respondents in view of the provisions of Section 17(1)([k)(4) of the Transfer Act, 2017.

Accordingly, writ petition is disposed of by directing respondent no. 3–Additional Director, (Elementary), School Education, Kumaon Mandal, Nainital, to take decision on the application of the petitioner dated 22.09.2025, annexure-6 to the writ petition, in the light of the provisions of Section 17(1)([k)(4) of the Transfer Act, 2017, and to pass appropriate orders, in accordance with law, within a period of four weeks from the date of production of a certified copy of this
order.

P1ending application, if any, stands disposed of accordingly.
