By filing this writ petition the petitioner prays for a mandamus directing the respondent-State authorities to allot shop no. A-3 situated at Dakbangla Campus, Barhait, District Sahebganj in favour of this petitioner. 3. The petitioner claims that the aforesaid shop was allotted to the brother of the petitioner but unfortunately the brother of the petitioner died. Learned counsel for the petitioner submits that since the brother of this petitioner is dead now the shop has to be allotted in favour of this petitioner after evicting respondent no. 5 in whose favour it has been allotted. 4. During course of the argument, on query, learned counsel appearing on behalf of the petitioner admits that the deceased brother of the petitioner has left behind a widow. 5. Considering the fact that the deceased brother of this petitioner has left behind a widow, I am of the opinion that the 2026:JHHC:10979 2 petitioner cannot have better right of allotment than the widow who is a class-I legal heir. Thus, the petitioner is not entitled for any relief. In this case the widow is not before this Court claiming allotment. 6. Accordingly, this writ petition stands dismissed.
