Learned Counsel for the petitioners submits that petitioner no. 2 has passed away after filing of the writ petition, therefore he is pressing the writ petition only qua the petitioner no. 1. According to him, petitioner no. 1 was engaged as daily wager in the Forest Department in 2005 and he is thereafter serving continuously since then, but his claim for minimum of pay scale is not being considered. (3) By means of this writ petition, petitioner has sought the following relief: “i) Issue writ order or direction in the nature of mandamus commanding and directing the respondents to pay the prevailing minimum of pay scale i.e. Rs. 21060.00 instead of Rs. 8213.00, as per recommendation of 7th Pay Commission and Dearness Allowance along with arrears, since the implementation of the 7th Pay Commission.” (4) Learned Counsel for the petitioner submits that petitioner be permitted to make representation claiming minimum of pay scale and the competent authority be directed to take decision on the same. (5) Learned State Counsel submits that he has no objection if the writ petition is disposed of in terms of the prayer made by the petitioner. (6) Writ petition is, accordingly, disposed of with liberty to petitioner no. 1 to make representation to the competent 2026:UHC:1928 authority. If he makes representation within two weeks from today, decision thereupon shall be taken, as per law, within ten weeks thereafter.
