Order No.
ORDER 16.03.2026
02.
1. Heard learned counsel for the respective parties.
2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Balichandrapur P.S. Case No.11 of 2026 corresponding to C.T. Case No.66 of 2026 pending in the court of learned J.M.F.C., Chandikhole on the grounds stated.
3. Perused the FIR as at Annexure-1. For the same incident, counter FIR was lodged from the side of the petitioners. This Court had directed the State to submit the case diary and the injury report by order dated 23rd February, 2026, in compliance of which, the same is produced today in Court and it is gone through. The medical examination report of the victim reveals that he received a laceration and one abrasion and both are simple injuries. As there has been counter FIRs by the parties against each other and since the informant has received simple injuries as made to reveal from his medical examination report, this Court recording the claim that they do p. 2 not have any similar antecedents is inclined to direct the petitioners to surrender before the learned court below for being released with suitable conditions imposed instead of acceding to their demand for pre-arrest bail.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioners to surrender before learned J.M.F.C., Chandikhole within a fortnight from today and in the event, they surrender in compliance thereof, shall be released on bail in connection with C.T. Case No.66 of 2026 on furnishing bail bonds of Rs.30,000/- (rupees thirty thousand) each with one solvent surety for the like amount each to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, they shall not pick up any quarrel with the other side while on bail and to cooperate the I.O. in the investigation, till it is over.
6. Issue urgent certified copy of this order as per rules.
