Heard the parties.
The petitioner has been made accused in connection with Jasidih P.S. Case No. 254 of 2023, registered for the offences punishable under Sections 302, 34 of I.P.C.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons has committed the murder of Huro@ Huran Pujhar. It is next submitted that the direct allegation of assault upon the deceased is against the co-accused Jaiky Pujhar, Gudan Pujhar, and Lochan Pujhar and only because the occurrence took place in the house of the informant, the informant has been arrayed as an accused. It is next submitted that there is no allegation of assault against the informant. It is then submitted that the petitioner has been in custody since 09.01.2026 as has been mentioned in para-16 of the bail application. It is then submitted that the petitioner has got no criminal antecedent as has been mentioned in para 15 of the bail application. It is also submitted the petitioner is an old man of 67 years. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the witnesses of the case in any manner during the trial of the
case. It is lastly submitted that the co-accused person with similar allegation has already been admitted to bail by a coordinate Bench of this Court vide order dated 06.03.2024 in B.A. No.9813 of 2023. Hence, it is submitted that the petitioner be admitted to bail.
Learned Addl. P.P. opposes the prayer for bail.
Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Deoghar, with the condition that he will co-operate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
