JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the proceedings in CC No.10425 of 2025 pending before the IX Additional Chief Judicial Magistrate, Bengaluru city, registered for offences punishable under Sections 498A and 506 read with Section 34 of IPC. 2. Heard Sri S Shashank, learned counsel appearing for the petitioners, Sri Anoop Kumar, learned High Court Government Pleader appearing for respondent No.1, Sri Pavan Kumar and Akash B Shetty, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into - 4 - HC-KAR NC: 2026:KHC:23051 CRL.P No. 6035 of 2026 a settlement and have placed on record such settlement along with the affidavits. Terms of settlement reads as follows: "AFFIDAVIT OF 2ND RESPONDENT I, Smt. Deepthi R. D/o Sri. Raghu, aged about 28 years, residing at "Nanda Gokula", 3rd Floor, 4th Cross, Teachers Colony, Gowramma Layout, Chandapura, Anekal Taluk, Bengaluru 099, solemnly affirm and state on oath as follows - 560099, solemnly affirm and stgate on oath as follows: 1. I am the 2nd Respondent/Complainant in the above Criminal Petition and as such I am well acquainted with the facts of the case and competent to swear to this affidavit. 2. I submit that the 1st Petitioner is my husband and our marriage was solemnized on 16.04.2023 in accordance with the prevailing Hindu customs. 3. I state that certain matrimonial disputes had arisen between myself and the 1st Petitioner, on account of which I had initiated criminal proceedings, which have culminated in C.C. No. 10425/2025 pending on the file of the learned IX Additional Chief Judicial Magistrate, Bangalore City, arising out of Crime No.0468/2024 registered by Hulimavu Police Station. 4. I further state that, with the intervention of elders and well-wishers, the disputes between myself and the Petitioners have now been amicably resolved. 5. I have also instituted proceedings in M.C. No.4086/2025 before the Family Court, Bangalore, seeking dissolution of marriage, and the matter has been settled in mediation. I state that as per the terms of the settlement, a sum of Rs.3,00,000/- has already been paid to me by the 1st Petitioner, and the balance sum of Rs.3,00,000/- is agreed to be paid at the time of hearing of the present petition before this Hon'ble Court. - 5 - HC-KAR NC: 2026:KHC:23051 CRL.P No. 6035 of 2026 6. I hereby state that I have no subsisting grievance whatsoever against the Petitioners and I undertake to appear before this Hon'ble Court and affirm the terms of settlement and I have no objection for quashing the entire proceedings in C.C. No.10425/2025 and which lead to the same. 7. I further state that I am voluntarily consenting to the quashing of the aforesaid proceedings out of my own free will, without any force, coercion, undue influence or pressure from any quarter. WHEREFORE, I respectfully submit that this Hon'ble Court may be pleased to compound and quash the proceedings as against the Petitioners in the interest of justice. I, the deponent named above, do hereby declare that the contents of this affidavit are true and correct to the best of my knowledge, information and belief. AFFIDAVIT OF THE 1ST PETITIONER I, Sri. Nischal Nag N. S/o Sri. Nagesh Kumar M., Aged about 28 yrs, R/at : No.29, 7th Main, 4th Cross, Akshay Nagar, Bengaluru 560068, do hereby solemnly affirm and state on oath as follows: 1. I submit that I am the 1st Petitioner in the above Petition and I am well aware of the facts and circumstances of the case. 2. I submit that the 2nd Respondent is my wife and our marriage was solemnized on 16.04.2023. Due to certain matrimonial differences, criminal proceedings came to be initiated, which have culminated in C.C. No. 10425/2025 pending on the file of the learned IX Additional Chief Judicial Magistrate, Bangalore City. 3. I state that the disputes between myself and the 2nd Respondent have now been amicably resolved with the intervention of elders and well-wishers. The 2nd Respondent has instituted M.C. No. 4086/2025 before the Family Court, Bangalore, and the matter has been settled in mediation. - 6 - HC-KAR NC: 2026:KHC:23051 CRL.P No. 6035 of 2026 4. I state that in terms of the settlement, I have paid a sum of Rs.3,00,000/- to the 2nd Respondent towards full and final settlement, and I undertake to pay the balance sum of Rs.3,00,000/- before this Hon'ble Court at the time of hearing of the present petition. 5. I further state that the 2nd Respondent has agreed to cooperate for quashing the proceedings in C.C. No. 10425/2025 and has no objection to the same. 6. I respectfully submit that in view of the amicable settlement between the parties, the continuation of the criminal proceedings would serve no useful purpose and I therefore pray that this Hon'ble Court may be pleased to quash the same in the interest of justice. I, the deponent named above, do hereby declare that the contents of this affidavit are true and correct to the best of my knowledge, information and belief. JOINT AFFIDAVIT OF THE 2ND, 3RD AND 4TH PETITIONERS We, Sri. Nagesh Kumar M. S/o Sri. Muniswamy, Aged about 56 yrs, Smt. Roopa Nagesh W/o Sri. Nagesh Kumar M. Aged about 48 yrs, Sri. Rahul Nag N. S/o Sri. Nagesh Kumar M. Aged about 23 yrs, all of us residing at No.319/1899,11th Cross, 1st Block, Viswapriyanagar, Begur Road, Bengaluru 560068, do hereby solemnly affirm and state on oath as follows - 1. We submit that we are the 2nd, 3rd and 4th Petitioners in the above Petition and are well aware of the facts and circumstances of the above case. 2. We submit that the marriage between 1st Petitioner and 2nd Respondent was solemnized on 16.04.2023. Due to certain matrimonial differences, criminal proceedings came to be initiated, which have culminated in C.C. No. 10425/2025 pending on the file of the learned IX Additional Chief Judicial Magistrate, Bangalore City. 3. We state that the disputes between 1st Petitioner and 2nd Respondent have now been amicably resolved with the intervention of elders and well- - 7 - HC-KAR NC: 2026:KHC:23051 CRL.P No. 6035 of 2026 wishers. The 2nd Respondent has instituted M.C. No. 4086/2025 before the Family Court, Bangalore, and the matter has been settled in mediation. 4. We state that in terms of the settlement, 1st Petitioner has paid a sum of Rs.3,00,000/- to the 2nd Respondent towards full and final settlement, and 1st Petitioner has further undertaken to pay the balance sum of Rs.3,00,000/- before this Hon'ble Court at the time of hearing of the present petition. 5. We further state that the 2nd Respondent has agreed to cooperate for quashing the proceedings in C.C. No. 10425/2025 and has no objection to the same. 6. We respectfully submit that in view of the amicable settlement between the parties to marriage, the continuation of the criminal proceedings against us would serve no useful purpose and we therefore pray that this Hon'ble Court may be pleased to quash the same in the interest of justice. We, the deponents named above, do hereby declare that the contents of this affidavit are true and correct to the best of our knowledge, information and belief." 4. The parties to the lis are present before the Court and are identified by their respective counsel. 5. In the light of application for compounding being filed along with the affidavits and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. - 8 - HC-KAR NC: 2026:KHC:23051 CRL.P No. 6035 of 2026 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition stands disposed. ii. Proceedings pending in CC No.10425 of 2025 pending before the IX Additional Chief Judicial Magistrate, Bengaluru city, against the petitioners stands quashed.
