Mr. Mahendra Singh Rawat, learned counsel for the contempt petitioner.

Petitioner alleges willful and deliberate non- compliance of the order dated 23.12.2025, passed in WPSS No. 2256 of 2025, Govind Prakash Sharma vs. State of Uttarakhand & Others, whereby respondent- Corporation, Garhwal Mandal Vikas Nigam, was directed to take decision in terms of the direction issued by the Tribunal within four months from the date of presentation of the certified copy of the order dated
23.12.2025.

The Tribunal passed an order in Claim Petition No.145/DB/2024, Sri Govind Prakash Sharma vs. State of Uttarakhand & Others, directing respondent- Corporation to take a decision qua the petitioner to mitigate his hardship vide order dated 30.07.2025. The respondent-Corporation has taken a decision on 13.04.2026, relying upon the decision of the Board of Director dated 28.08.2025.

Learned counsel for the petitioner submits that the respondent-Corporation was required to take a decision only in respect of the petitioner and the decision taken by the Board of Directors of the respondent-Corporation is a joint decision and was taken prior to the passing of the
order of this Court dated 23.12.2025.
5. This Court finds no substance in the submission
2 made by the learned counsel for the petitioner, as the decision has been taken on the basis of the earlier decision dated 28.08.2025 passed by the Board of Directors of the respondent-Corporation. Petitioner, if aggrieved by the said decision, may approach the appropriate forum for redressal of his grievance.
6. In view of the above, this Court is of the opinion that no case of contempt is made out. Accordingly, the contempt petition is hereby dismissed.
