The instant application under Section 151 of CPC has been filed on behalf of the applicant/respondent- Inder Singh for release of the balance awarded amount of compensation, lying deposited in the Registry of this Court.
2. As per the applicant, he is in dire need of money for the education of his children as well as to meet out other expenses. Therefore, it is prayed that entire balance amount of compensation alongwith up-to-date interest may be released in his favour. The application is duly supported with the affidavit of Vidya Devi, who is wife and guardian of the applicant, appointed by this Court.

Learned counsel for the non-applicant/appellant submitted that he does not want to file any reply to the application and has no objection in case the amount is released in favour of the applicant as no appeal has been preferred against the judgment dated 05.12.2005, passed by this Court and the same has attained finality.
4. Heard. Having perused the averments made in the application, which is duly supported with the affidavit of the guardian & wife of the applicant and also in view of the fact
that the judgment passed by this Court has attained finality, this Court finds it in the interest of justice to release the entire balance amount of compensation, along with up-to-date interest, lying deposited in the Registry of this Court, in favour of the applicant/respondent, after proper verification and identification by remitting the same to the bank account of Vidya Devi, copy whereof has been annexed with the application as Annexure A-1.
