The petitioners are apprehending their arrest in connection with Poraiyahat P.S. Case No.02 of 2026, registered for the offence under Sections 126(2), 115(2), 117(2), 351(2), 109, 352 and 3(5) of the BNS, 2023, pending in the Court of the learned S.D.J.M., Godda. 3. Learned counsel appearing for the petitioners submits that the petitioners and informant are agnates. He further submits that scuffle took place due to removing the pumping set from the field. He then submits that petitioner no.1 is the father and petitioner no.2 is the son of petitioner no.1. He also submits that there are case and counter case between the parties and both the sides have received injuries. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations of assault are there and even injuries have been received. 5. Considering that both the sides are agnates and there are case and counter case between the parties and the altercation took place while ( 2026:JHHC:11214 ) -2- A.B.A. No. 1750 of 2026 removing pumping set from the field and in paragraph 14 of this application, it has been disclosed that the petitioners are having no criminal antecedent and in that view of the matter, the petitioners are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions as the learned Court may deem fit and proper. 6.
