Heard learned counsel for the Petitioner as well as learned Additional Government Advocate for the State- Opposite Parties. Perused the writ application as well as the documents annexed thereto. 3. The Petitioner has filed the present writ application with the following prayer: “It is therefore prayed that the Hon’ble Court may be graciously pleased enough to admit the writ petition, issue notice to the Opposite Parties and after hearing the parties issue a writ of mandamus directing the Opposite Parties more particularly to the Opposite Party No. 4 and 3 for re-submitting and forwarding Page 2 of 3. the pension paper with proper documents/ complete information in the office of the Accountant General (A & E), Odisha, Bhubaneswar in order to release pensionary benefits i. e. Gratuity amount of the petitioner like the case of (Dhruba Charan Panda -Vrs- State of Orissa and others) decided on 08.09.1999 in OJC No. 6885 of 1999 within a reasonable time to be stipulated by this Hon’ble Court And pass such other or further order or orders as the Hon'ble Court may deem fit and proper to the facts and circumstances of the case.” 4. It is submitted by learned counsel for the Petitioner that although the Petitioner has filed representation dated 06.05.2025 before the Opposite Party No.3 under Annexure-5, but the same is still pending before the said Opposite Party and the said Opposite Party has not taken any decision as of now. 5. Learned counsel for the State submits that he has no objection, if a direction is given to the authority concerned to consider the representation of the Petitioner in accordance with law within a stipulated period of time. 6. Considering the submissions made by the learned counsel appearing for the respective parties and without expressing any opinion on the merits of the case, this Court disposes of the writ petition at the stage of admission with a direction to the Opposite Party No.3 to consider the Page 3 of 3. representation of the Petitioner dated 06.05.2025 under Annexure-5 in accordance with law within a period of eight weeks from the date of production of a certified copy of this order. It is needless to mention here that the representation of the Petitioner shall be considered and disposed of by passing a speaking and reasoned order. Any decision so taken on the said representation shall be communicated to the Petitioner within ten days thereafter. Urgent certified copy of this order be granted on proper application.
