Shastri, A.P.P. ------ 05/ 17.04.2026 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner is apprehending his arrest in connection with Ahilyapur P.S. Case No. 42 of 2025, registered for the offence under Sections 303(2) and 317(2) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Giridih. 3. Learned counsel appearing for the petitioner submits that false allegations are made of keeping the stolen diesel and selling the same in the lower price. He next submits that the said diesel was purchased from a particular petrol pump and the receipt was also produced and on query the said petrol pump has not disputed the said receipt. He further submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-18 of the petition. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that illegally the diesel was stored by the petitioner. 5. Considering that the receipt of the diesel was not disputed by the concerned petrol pump and further the petitioner is having no [2026:JHHC:11081] -2- criminal antecedent and disclosure to that effect has been made in para- 18 of the, in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
