JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners – husband and his family members are before this Court calling in question proceedings in C.C.No.9644/2021, pending before the II Additional Senior Civil Judge and JMFC, Tumakuru, for the offences punishable under Sections 498A, 504 and 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis were before the family court in M.C.No.4566/2022 and have settled their matrimonial dispute amicably by drawing up certain terms and conditions before the mediation center. They are before this Court seeking permission to compound the offences. The parties have filed an application under Section 320(2) r/w. 320(8) of the Cr.P.C. before this Court to that effect. 3. The application reads as follows: “2) It is submitted that the Petitioner No.1 and Respondent No.2 are husband and wife and at the advice of the well-wishers, the parties after deliberate discussion have come to the conclusion to settle the interest dispute between parties by in M.C.No.4566/2022 before - 4 - HC-KAR NC: 2026:KHC:10750 CRL.P No. 1493 of 2026 Bengaluru Mediation Centre, Bengaluru on 21-11-2025 by filing Memorandum of Settlement under Section 89 of CPC R/W Rules 24 and 25 of the Karnataka Civil Procedure(Mediation Rules), 2005 and the relevant details are below; free and full & Final Settlement of Rs.6,75,000/- out of which: i) at Para 4(a) the Petitioner No.1 herein has agreed to pay a sum of Rs.2,00,000/- (Rupees Two Lakhs Only) at the time of closure/quashing the present impugned proceedings at in C.C.No.9644/2021 pending on the file of the Hon'ble II Additional Senior Civil Judge & JMFC at Tumakuru, accordingly, the Petitioner No.1 is paying amount of Rs.2,00,000/-(Rupees Two Lakhs Only) vide way of DD bearing No.553260 dated 12-02-2026, withdrawn on IDBI bank Tumkuru and the receipt of the same is duly acknowledged by the respondent No.2 herein ii) The respondent No.2 herein is not having any objections to quash the entire proceedings in C.C.No.9644/2021 pending on the file of the Hon'ble II Additional Senior Civil Judge & JMFC at Tumakuru for the alleged offence under section 498-A, 504, 506, R/w 34 of Indian Penal Code and section 3, 4 of Dowry Prohibition Act against the Petitioners. 4) It is submitted that the parties have entered into this Joint Compromise Petition out of free mind and without any undue influence. The petitioner No.1 has greed to pay balance of Rs.2,75,000/- before family court in M.C.No.4566/2022.” In the light of the fact that the parties have arrived at settlement by parting their ways on certain terms and since it is - 5 - HC-KAR NC: 2026:KHC:10750 CRL.P No. 1493 of 2026 a marital dispute, I deem it appropriate to accept the application and terminate the proceedings against the petitioners, as the allegations are not against the State. 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed.
