3 VS,J W.P.No.35587 of 2018
ORDER:
The present Writ Petition is filed questioning the action of the respondents in not furnishing a certified copy of the Pattadar Passbook/D-form Patta in respect of the assigned land admeasuring Ac.0.80 cents (0.32 hectares) in Sy.No.134, situated at Nathuram Tank, Mangalagiri Town and Mandal, Guntur District. 2. The case of the petitioner is that since the father of the petitioner was a landless poor, he was identified as one of the beneficiaries and assigned 0.32 hectares (0.80 cents) of Agriculture land in Sy.No.134, situated at Nathuram Tank, Mangalagiri Town and Mandal, Guntur District in the year 1978. As the petitioner lost the original assignment documents including D-Form Patta and Pattadar Passbook, made a representation to the District Collector, Guntur on 05.07.2018 for grant of certified copy of Pattadar Passbook/D-Form patta for the subject land, however, the District Collector has not considered the same, therefore, the petitioner filed the present writ petition. 3. Respondent No.5 has filed a counter-affidavit duly stating that the petitioner had submitted a representation on 05.07.2018 before the District Collector, Guntur through “Mee Kosam Petition” No.16889878-2018, dated 23.07.2018, requesting issuance of a duplicate copy of the D-form patta and pattadar pass book in respect of the land in Sy.No.134 situated at Nathuram Tank, Mangalagiri Town and Mandal. Thereafter, 5th respondent issued an endorsement vide Spl.Reg.No.352/2018-C, dated 01.08.2018, informing the petitioner that, as per the revenue records, Sy.No.134 is classified as

"Nathuram Tank" and recorded as "Government Poramboke", and that no assignment file relating to Sy.No.134 of Mangalagiri Village is available in their office. 4. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. 5.
On a perusal of the counter-affidavit filed by the 5th respondent, it can be understood that, pursuant to the application submitted by the petitioner, the 5th respondent has also issued an endorsement dated 01.08.2018. The said endorsement has also been filed along with the counter-affidavit, which shows that it was acknowledged by the petitioner on the very same day. 6. In view of above, this Court do not find any merits in the writ petition, as the petitioner's request has already been considered and disposed of by the 5th respondent by issuing the endorsement dated 01.08.2018. However, it is open to the petitioner to challenge the said endorsement, if so advised, in accordance with law. 7. Accordingly, the Writ Petition is disposed of, granting liberty to the petitioner to challenge the endorsement dated 01.08.2018 issued by the 5th respondent, if so advised. No costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed. ___________________ JUSTICE V.SUJATHA
