Appellants filed a suit for injunction, which was registered as O.S. No. 37 of 2014. Plaint of that suit was rejected on an application filed by the defendants under Order 7 Rule 11 CPC. Appellants challenged Trial Court’s order by filing Civil Appeal No. 95 of 2014, which too was dismissed by First Additional District Judge, Rishikesh, Dehradun, vide judgment dated 22.01.2015. Challenging the judgment and orders passed by Trial Court as well as Appellate Court, plaintiffs have filed this Second Appeal. 4. Today, the matter is listed on a withdrawal application. 5. Learned counsel for the plaintiff- appellants submits that the parties have settled the dispute amicably amongst themselves; therefore, the appellants do not want to press the appeal. He further submits that appellants have moved an application seeking withdrawal of the Second Appeal. 6. Mr. Nikhil Joshi, holding brief of Mr. Piyush Garg, Advocate for the respondents submits that he has no objection to the prayer for withdrawal of the Second Appeal. 2026:UHC:4604 7.
