Learned advocate appearing for the petitioner submits that the petitioner is similarly situated as the other accused person, who has been granted bail in C.R.M. (M) 1639 of 2025 and C.R.M. (M) 1748 of 2025 and, as such, should be released on bail. Learned advocate appearing for the State opposes the bail and submits that so far as the locus of the present petitioner is concerned he is similarly situated but he has one antecedent and further in the present case at his instance the offending weapon was recovered. Be that as it may, having considered the totality of the circumstances and the contributory part of the offence so far as the other accused persons are concerned as it reflects from the case 2 diary, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Mukimuddin Ahammed shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Raiganj, Uttar Dinajpur. If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Trial Court and shall not leave the jurisdiction of the district of Uttar Dinajpur without prior permission of the learned Trial Court. The application for bail, being C.R.M. (M) 526 of 2026, is, thus, allowed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
