THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE V SRISHANANDA ORAL ORDER After addressing the arguments for some time, learned counsel for the revision petitioner files a memo. Memo reads as under: “1. The petitioner is liable to pay Rs.16,90,000/- as per the order passed by the Trial Court and confirmed by the First Appellate Court. 2. The petitioner in terms of interim order deposited sum of Rs.5,90,000/- remaining amount liable to be paid by petitioner is Rs.10,95,000/-. 3. The both the parties agree to settle the dispute and the petitioner is undertake to pay balance amount of Rs.10,95,000/- in 8 (eight months) and by the petitioner from today that is on 03.03.2026. 4. The petitioner is undertake to pay the aforesaid amount in 8 installments that is sum of - 3 - HC-KAR NC: 2026:KHC:13000 CRL.RP No. 1040 of 2021 Rs.1,30,000/- on or before 30th of each month by the end of 30.10.2026. The remaining due of Rs.55,000/- will be paid on or before 30.10.2026 inclusive of the last installment. 5. The above mentioned terms are agreed by the parties, the amount paid by way of DD before the Trial Court.” Learned counsel for the respondent has endorsed no objection on the memo. Placing the memo on record, revision petition stands disposed of. After payment of entire fine amount, as per the memo, sentence of imprisonment stands set aside. However, it is made clear that if there is any default in payment of compensation amount, as per the contents of the memo, revision petitioner shall undergo simple imprisonment as ordered by the learned Trial Magistrate confirmed by the First Appellate Court.
