GP FOR REVENUE The Court made the following: SRK, J W.P.No.15929 of 2026 3 O R D E R This Writ Petition is filed seeking the following relief: “….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of 5th respondent in dumping garbage and waste material in the petitioner’s private land admeasuring Ac.4.05 cents in Sy.No.236 situated at Vakalapudi village, Kakinada Rural Mandal, Kakinada District, without acquiring the same, without issuing any notice, without paying compensation and without following due process of law and the consequential action of 6th respondent in interfering with the petitioner’s peaceful possession and enjoyment over the subject land, calling the petitioner to the police station, detaining him from morning to evening and threatening to foist false criminal cases against him for objecting to the illegal dumping of garbage, as illegal, arbitrary, high-handed and violative of the principles of natural justice and Articles 14, 21 and 300A of the Constitution of India, and consequently direct the respondents not to dump garbage or waste material in the petitioner’s subject land, not to interfere into the petitioner’s peaceful possession and enjoyment over the said land, and further direct 6th respondent not to harass the petitioner or call him to the police station or threaten him in connection with the petitioner’s lawful objection to the dumping of garbage in his private land, and pass such other order or orders …” 2. Grievance of the Writ Petitioner is that 5th respondent is dumping garbage and waste material in his private land admeasuring to an extent of Ac.4.05 cents in Sy.No.236 situated at Vakalapudi Village, Kakinada Rural Mandal, Kakinada District, without acquisition, without notice, without payment of compensation and without following due process of law. Though the respondent No.5 stopped SRK, J W.P.No.15929 of 2026 4 dumping garbage and waste material for sometime pursuant to the direction issued by the respondent No.2, the same was continued with the active support of respondent No.6, without any authority. Hence, the Writ Petition. 3. Today, when the matter is taken up for hearing, learned counsel for the Writ Petitioner submits that pursuant to filing of the present Writ Petition, the respondent authorities acted upon positively in removal of dumping garbage and waste material from the said premises. In view of the said reason, learned counsel for the Writ Petitioner fairly conceded to the extent that no orders are required in the present Writ Petition. 3. Recording the submission made by the learned counsel for the Writ Petitioner, the Writ Petition is closed. There shall be no order as to costs of the Writ Petition.
