Learned advocate appearing for the petitioner submits that from the present petitioner and others 25.56 Kgs. of Ganja were recovered and the petitioner was in custody for 1 year and 10 months. Earlier there was a direction in the month of July to conclude the trial within a period of 6 months. Till date only some of the witnesses have been examined and yet others are to be examined.
State has opposed the prayer for bail.
I find from the seizure list that the 5 witnesses are of from the Police Department. There is hardly any scope for delaying the trial.

Be that as it may, having regard to the period undergone by the present petitioner I am of the view that further incarceration is unwarranted.
Accordingly, the prayer for bail of the petitioner is allowed. Petitioner, namely, Md. Tanweer shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Court under NDPS Act cum Learned Additional Sessions Judge, 3rd Court, Asansol, Paschim Bardhaman.
If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Paschim Bardhaman without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 1727 of 2025 is allowed.
