1. The petitioner’s name features in the list of tainted candidates published by the Commission. The petitioner is aggrieved by the same.
2. Submission is that the reason for taint discloses that the petitioner was wrongly recommended even though his name did not appear in the list of recommended candidates. The petitioner did not join service.
3. Prayer has been made to direct the Commission to remove his name from the list of tainted candidates.
4. The submission of the petitioner is akin to the submission made by some of the tainted candidates before the Hon’ble Supreme Court in the matter of Baishakhi Bhattacharjee (Chatterjee). In paragraph
2 nos.38 and 39 of the judgment dated April 3, 2025, passed by the Hon’ble Supreme Court it is evident that the submission of the tainted candidates was considered and the Court was of the opinion that the issue of authenticity of data need not be decided in the writ proceeding as it falls under the purview of the criminal court.
5. Whether the petitioner’s name has been rightly incorporated in the said list or not has to be decided by a separate competent forum. The writ court is not an appropriate forum to take a decision apropos the prayer of the petitioner.
6. In view of the above, no relief can be granted to the petitioner.
7. The writ petition fails and is hereby dismissed.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
