JUSTICE DEVASHIS BARUAH ORDER Date : 06.05.2026 None appears on behalf of the Petitioners on call. 2. Mr. M. Nath, the learned Senior counsel assisted by Mr. A. Bhattacharjee, the learned counsel appears on behalf of the Respondent No.1. None has appeared on behalf of the other Respondents. 3. This is an application filed for initiating contempt proceedings for willful and deliberate violation to the order dated 04.10.2019 passed in WP(C) No.7512/2019 whereby the learned Coordinate Bench of this Court had directed the Respondent Nos. 3, 4 and 5 in the said proceedings to verify as to whether the Petitioners therein had rendered services as President, Vice-President and Members of the different wards of the various Anchalik Panchayats under the Dhubri Zilla Parishad and if it is found that they had rendered services as per their Page No.# 8/9 claim, they be paid the due remuneration for the period of service rendered by them. 4. Mr. M. Nath, the learned Senior counsel appearing on behalf of the Respondent No.1 submitted that the Respondent No.1 had already been transferred out of the P&RD Department in the year 2021 itself and retired on 31.01.2022. The learned Senior counsel further submitted that at the time when the Respondent No.1 was there, there was an order being passed by the Respondent No.1 thereby directing the Chief Executive Officer, Dhubri Zilla Parishad to take immediate necessary steps for providing the pending honorarium to the PRI representatives i.e. the Petitioners under the Debitola Anchalik Panchayat, Jamadarhat Anchalik Panchayat and Gauripur Anchalik Panchayat as per the directions passed by this Court in the order dated 04.10.2019 in WP(C) No. 7512/2019. In that regard, the learned Senior counsel has placed before this Court the order dated 04.09.2020 which is kept on record and marked with the letter “X”. 5. This Court also finds it pertinent to take note of that on 16.10.2023, the fact that the Respondent No.1 had already been transferred from the P&RD Department and subsequently retired was brought to the notice of this Court and the said aspect was duly recorded. The counsel for the Petitioners Page No.# 9/9 thereupon took time for filing appropriate application. Almost 3 (three) years have passed by, but till date, no steps in that regard have been taken. 6. It is the opinion of this Court that without taking steps for filing application seeking impleadment of the present incumbents, the present contempt proceedings cannot be brought to a logical conclusion. 7.
