Keshri, A.P.P. 03/17.04.2026 Heard learned counsel for the applicant and the learned A.P.P. appearing for the State. 2. The applicant, who is in custody since 13.06.2025 has approached this Court for grant of regular bail in connection with Garhwa (Town) P.S. Case No. 741 of 2020 corresponding to G.R. Case No. 1740(A) of 2021, registered for the offence under Section 379 of the I.P.C, pending in the court of learned Chief Judicial Magistrate, Garhwa. 3. It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. along with its enclosures have been annexed with this bail application and there is no suppression on his/her part. 4. It appears that earlier the bail application of the applicant being B.A. No. 8883 of 2025 has been dismissed as withdrawn vide order dated 26.09.2025. It has been submitted that two witnesses have already been examined and he has got one criminal antecedent that is with regard to the same Bolero vehicle, which is article of theft. However, in the said case the applicant has been acquitted and statement to that effect has been made at para 7 and 8 of the bail petition. 5. Learned A.P.P. has opposed the prayer for bail of the applicant stating that he has one criminal antecedent. 6. Considering the period of custody, I am inclined to enlarge the applicant on bail. 7. Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, , Gahrwa in connection with 2026:JHHC:11035 2 B.A. No. 2326 of 2026 Garhwa(Town) P.S. Case No. 741 of 2020 corresponding to G.R. Case No. 1740(A) of 2021 , subject to condition that the applicant(s) will submit self-attested photocopy/photocopies of his/her/their Aadhaar Card(s) and also submit his/her/their mobile number(s) before the learned trial court which he/she/they will always keep active and will not change it during pendency of this case without prior permission of the court.
