The petitioner’s grievance in the writ petition is that two of the papers which he had unsuccessfully attempted while pursuing his degree in Mathematics Honours from the Bangabasi College were not reevaluated, inspite of making representations for such purpose. 2. Mr. Khan has argued that even though there is no specific provision in the university rule, a reevaluation of the papers for which he had unsuccessfully attempted could be done as the petitioner will face grave prejudice if such reevaluation is not permitted. 3. Mr. Chatterjee, appearing for the University has submitted that under the Rule 20(ii) of the University Notification No. CSR/3/18, dt. 07.05.2018 and CSR/4/18, dt. 07.05.2018 the petitioner is not entitled or eligible to seek reevaluation of the answer scripts. The 2 said rule applies only for semester examination and not for supplementary papers, of which the petitioner seeks reevaluation. 4. In any event, Mr. Khan has agreed that the petitioner would be better off taking the supplementary examinations on a second occasion for the very same papers, since he is otherwise eligible. 5. In view of the aforestated, I direct the University to permit the petitioner to sit for the supplementary examinations of all the papers in which he had been unsuccessful, provided he is eligible otherwise and fulfills the criteria required to sit for such supplementary examinations. 6. Needless to state that the University will afford the earliest available opportunity to the petitioner to take these examinations without, in any manner, being influenced by the writ petition or the observations made herein. 7. With the aforestated directions, the present writ petition is disposed of. 8. There shall be no order as to costs. 9.
