1. By means of present petition, petitioner has sought a direction commanding the respondents to provide petitioner the benefit of annual increments alongwith arrears and to confirm the petitioner on the post of Junior Assistant in the college of respondent nos.4 and 5.
2. It is contended by learned Senior Counsel appearing for petitioner that respondent no.4 runs a college in the name and style “Kanhaiya Lal DAV (Post Graduate) College, Roorkee, Haridwar”. The petitioner was appointed as Junior Assistant in the said institution on 10.02.2020.

The grievance of the petitioner as canvassed through this writ petition is that the petitioner was not granted annual increments, and his services on the post of Junior Assistant have not been confirmed. The petitioner submits that the institution is under grant-in- aid and the services of the petitioner are regular. For this reason, petitioner is before this Court in the present writ petition seeking a direction, referred to hereinabove.
4. It is contended by the learned Senior Advocate that the petitioner has submitted a representation on 12.12.2025 to respondent no.5-Principal of the Institution praying for grant of annual increment and confirmation. Respondent no.2-Director Higher
Education was provided complete information, as asked for, by the Director vide letter dated 19.05.2025, and requested respondent no.2-Director, Higher Education to give direction to respondent no.5-Principal of the Institution.

Learned counsel for the petitioner submits that despite the aforesaid communication, till date, grievances of petitioner regarding annual increment and confirmation have not yet been redressed.

From perusal of the communication made between the parties, it reflected that the representation should have been made to the respondent no.2-Director Higher Education through proper channel i.e. through respondent no.5-Principal of the Institution, and it is only when such representation is moved, the respondent may take decision thereon.
7. In this view of the matter, the writ petition is finally
disposed of giving liberty to the petitioner to move a detailed representation ventilating his grievance to the Director through respondent no.5-Principal of the Institution within 10 days from today; and if such representation is presented to respondent no.2-Director, Higher Education, he shall take decision thereon within next eight weeks from the date of receipt of representation by passing a speaking and well-reasoned
order strictly in accordance with law.
