MISC. NO. 43/2022 AT ANNEXURE-A AND ETC. THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE DR. JUSTICE K.MANMADHA RAO ORAL ORDER Learned counsel for the petitioners and learned counsel for the respondent are present before the Court. The parties are also present. 2. On the earlier date, i.e., 10.03.2026, learned counsel for the respondent gave an undertaking to pay a sum of Rs.5,00,000/- by way of demand draft. Today, the same has been produced before this Court. The demand - 3 - HC-KAR NC: 2026:KHC:15099 WP No. 22502 of 2023 draft is handed over to the petitioners, who acknowledge receipt of the same. 3. A joint memo has been filed by the parties before the Taluk Mediation Centre, Channarayapatna, on 12.09.2025. The same reads as follows: “1. The Petitioner has filed a complaint against respondent under Section 125 of the Cr PC seeking maintenance. 2. The marriage between the parties was solemnised on 07/12/2020 at Sri Kabballi Basaveshwara Swamy Sannidhi, Kaballi, Hirisave Hobli, Channarayapatna Taluk, Hassan District, as per the Hindu rites and customs. 3. The petitioners have lead a happy married life for 2 months after their marriage, and as a result of their marital life, a daughter named Lasya D/o. Ajith Kumar M.B. was born. Since then, the Petitioner and the respondent have been living separately for 4 years without any physical contact between them and since then, they have not been leading married life without any physical and mental contact between them and due to many disagreements, both of them have been living - 4 - HC-KAR NC: 2026:KHC:15099 WP No. 22502 of 2023 separately. The Petitioner and the respondent have agreed to settle the above case through mediation and accordingly, the respondent has agreed to receive Rs. 6,00,000/-(Six Lakh) as maintenance For the daughter Lasya Rs. 1,00,000/- (One Lakh) as maintenance for her life. The Respondent has agreed to deposit of Rs. 5,00,000/- out of Rs.6,00,000/- as agreed, in the name of the 2nd Petitioner in State Bank of India, Dabbegatta Branch as a Fixed Deposit (FD) till her attaining the age of majority and appoint the 1st Petitioner Varsha H.R. as the nominee of her daughter and to pay the remaining amount of Rs.1,00,000/- to the 1st Petitioner in the form of DD and have agreed to produce the relevant documents before the court. Further, the 1st Petitioner has agreed to keep the 2nd Petitioner in his custody and bear the living and maintenance and other expenses of 2nd Petitioner. She has agreed apart from the above not to claim any other maintenance. 4. The Petitioner has agreed to give evidence as an adverse witness in the case filed against the respondent in the same court for recovery of maintenance vide Criminal Mis No. 611/2024 and also in the case filed in the court of the Principal Civil and J.M.F.C. Judge vide C.C. No.1381/2023. Similarly, the Petitioner has agreed to obtain a - 5 - HC-KAR NC: 2026:KHC:15099 WP No. 22502 of 2023 divorce in the application filed against the respondent in the Senior Civil Court vide M.C. No.- 108/2024. Similarly, the Petitioner has agreed to withdraw and close the cases filed against the respondent in the Karnataka High Court vide W.P. 22502/2023. Henceforth, both the parties will not have any kind allegations, offences, accusations against each other. The expenses of both parties have been decided by the parties. The expenses are to be borne by them. 5. In accordance with the above agreements, both the parties have agreed to get the above case dismissed by submitting the above compromise petition before this Honorable Court”. 4.
