2. By means of this writ petition, petitioner has sought the following relief:
“Issue a writ, order or direction in the nature of mandamus commanding respondent no. 2 to consider and decide the petitioner’s pending applications dated 19.06.2025 (Annexure no. 8) page No. 37 and 07.01.2026 (Annexure No 9) page No. 38 to 41 regarding mutation of the property in question, within a stipulated period as may be fixed by this Hon’ble Court, after affording opportunity of hearing to all concerned parties and strictly in accordance with law.”

Learned counsel appearing for Nagar Palika Parishad, Mussoorie submits that earlier, name of the petitioner was mutated in Municipal records as owner of some property; however, order of mutation was subsequently recalled on an application moved by other co-sharers, whose name was left out.
4. He submits that petitioner has now moved another application for mutation of
2026:UHC:4560 the property in question in his name and, he has no objection if the writ petition is
disposed of in terms of the prayer made by petitioner.
5. The writ petition is, accordingly,
disposed of by providing that the competent authority in Nagar Palika Parishad, Mussoorie shall consider petitioner’s request for mutation, within six months from date of presentation of certified copy of this order and pass appropriate order, as per law, after hearing all stakeholders/persons who are claiming any right, title or interest over Makranak Bell Estate.
6. The competent authority shall have a public notice published in newspaper at the cost and expense of the petitioner, so that other persons having any right, title or interest over the property in question have sufficient notice about the prayer for mutation made by petitioner.
