With the consent of both the parties the present writ petition is disposed in the terms that the order dated 10.09.2024 is hereby caused and set aside and the present petitioner is permitted to be taken on record in place of appellant No. 1 before the Appellate Rent Tribunal as her legal heir. 2. However, it is made clear that the mere impleadment of the petitioner as a legal heir of appellant No. 1 Pratibha Devi will not amount or will not effect finding on issue No. 6A. 3. The Appellate Rent Tribunal would be at liberty to form its own opinion as it thinks fit on issue No. 6A after hearing parties. 4. Considering the additional innocuous prayer of the learned counsel for the respondent that the appeal under the Rent Control Act, 2001,(hereinafter referred to as the 'Act of 2001) is pending before the learned Appellate Rent Tribunal may be ordered to be [2026:RJ-JP:7814] (3 of 3) [CW-16013/2024] decided as expeditiously as possible. Therefore, this Court deems it appropriate to direct the learned Appellate Rent Tribunal to decide the appeal as expeditiously as possible taking into consideration the provisions of Section 19(8) of the act of 2001. 4.
