NARENDRA PRASAD ORAL ORDER This writ petition is filed under Articles 226 and 227 of the Constitution of India challenging the order dated 13.01.2026 passed by the XXIV Additional City Civil and Sessions Judge, Bangalore, in F.D.P.No.142/2025, whereby the IAs filed by the respondent herein for initiating contempt proceedings have been allowed. 2. The respondent herein had filed a suit in O.S. No.1697/2022 for partition and separate possession. The suit was decreed. Being aggrieved by the same, the petitioner herein has filed a Regular First Appeal in RFA No.1857/2025 before this Court. In the meantime, the respondent herein filed F.D.P. No.142/2025. In the said proceedings, an interim order was granted on 15.09.2025. - 3 - HC-KAR NC: 2026:KHC:15141 WP No. 7377 of 2026 3. The contention of the respondent herein is that the petitioner herein has violated the said interim order. Therefore, she filed I.A.No.V under Section 151 of the Code of Civil Procedure. The Trial Court reserved liberty to the respondent herein to initiate separate contempt proceedings. However, instead of disposing of I.A.No.V accordingly, the same has been allowed. Therefore, the petitioner is before this Court. 4. The Final Decree Court, by the impugned order, has reserved liberty to the respondent herein to initiate separate contempt proceedings against the respondent therein for disobedience, and pursuant to the same the respondent herein has already filed a contempt petition in C.C.C.No.233/2026.
