This bail application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 wherein, prayer has been made for grant of bail as the petitioner is in custody in connection with POCSO Case No. 6 of 2026 arising out of Devipur P.S. Case No. 134 of 2025 for allegedly committing offence punishable under Sections 137(2), 87, 352, 351(2), 3/5 of the B.N.S. and under Section 8 of POCSO Act which is pending in the Court Learned Special Judge, POCSO, Deoghar. 4. Heard, learned counsel for the petitioner, learned counsel for the State and perused the statement of the victim recorded under Sections 183 of the B.N.S.S. 5. Learned A.P.P. opposes the prayer for bail. 6. The petitioner who happens to be the relative of the victim has assaulted her sexually. 7. I have gone through the statement of the victim recorded under Section 183 of the B.N.S.S wherein, she supports the allegation against the petitioner. 8. Considering the aforesaid, I am not inclined to release the petitioner on bail. This bail application is hereby dismissed at this stage 2026:JHHC:7223 2 with a liberty to renew his bail application after examination of the victim as prosecution witness. 8.
