Learned advocate appearing for the petitioner submits that petitioner was arrested on 25.04.2023 and since then she is in custody. Prosecution intends to examine 47 witnesses and till date only 15 witnesses has been examined. As such, there is no possibility of the trial concluding in near future. Thus, the petitioner be released on bail on any stringent condition.
On the other hand, learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the documents which include the evidence of the son of the victim.
Be that as it may, I have considered the complicity of the present petitioner which are available in the case diary.
2 Having regard to the same and considering the period of detention, I direct the learned Trial Court to complete the prosecution witnesses by 30th September, 2026. In case, there is non-cooperation from the side of the accused, learned Trial Court will specifically record the same in the relevant orders.
At this stage, the prayer for bail of the petitioner in CRM(M) 327 of 2026 is rejected.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
