Mr. Pabitra Charan Bhattacharjee …for the petitioner Mr. Pradeep Kumar Roy, Sr. Advocate Mr. Partha Sarathi Pal …for the respondent nos. 1 to 3 The petitioner is aggrieved by the direction passed by the Assistant Registrar of Cooperative Societies, Paschim Medinipur Range on December 4, 2025 thereby accepting the counter-claim of the respondent nos. 4, 5 and 6. Learned advocate appearing for the petitioner submits that in a dispute case, there is no provision to file a counter-claim along with the written- statement. Mr. Roy, learned Senior Advocate appearing for the respondent nos. 1 to 3 submits that in the meantime the Arbitrator has already passed an order dated January 9, 2026 observing that additional written-statement and counter-claim is actually a
money suit in nature and is required to be filed before the ARCS, Paschim Medinipur with proper court fees. It was further observed in the said order that the defendant nos. 1 to 3 are required to file a fresh money suit against the plaintiff instead of counter- claim with proper court fees for further action. It appears that the grievance of the petitioner stands redressed with the passing of the order dated January 9, 2026 and nothing survives to be decided in this writ petition.
