2. This writ petition is filed by Poornagiri College of Education, which imparts education in various subjects, including Law.
3. According to the petitioner, Bar Council of India granted recognition for conducting LLB course in the said college during academic year 2018-2019 and 2019-2020; however, recognition has not been given thereafter by Bar Council of India.
4. Counsel appearing for Bar Council of India, however, submits that Kumaon University, Nainital granted affiliation to petitioner’s college for academic years 2020-2021, 2021-2022 and 2022- 2023 only on 12.04.2024.
5. He submits that because of this delay in grant of affiliation by the University, Bar Council of India could not take decision in the matter and grant of recognition is also getting delayed.

Learned counsel the Bar Council of India relies upon Rule 15 and 16 of Rules of Legal Education, 2008 which is extracted below:
15. Annual Notification for application to be filed by newly proposed institutions:
(a) At the direction of the Legal Education Committee, the Secretary shall notify each year prescribing the last date for submission of new application for proposing new law courses in a University or a new affiliated Centre of Legal Education under an existing recognized University but not later than December 31 of the previous academic year to which the new proposal is applied for. No application received after that date can be considered for the academic year under notification but can be considered for the subsequent year.
(b) On receipt of each application the Secretary shall submit his note after ascertaining all relevant facts to the Chairman of the Bar Council of India who may then instruct to refer the application to the inspection committee for inspection and report. After receiving the report from the Inspection Committee, the Secretary shall place the file before the Legal Education Committee for its recommendation to the Bar Council of India for approval of the affiliated Centres of Legal Education or recognition of the degree in law of the University as the case may be. (c) The Legal Education Committee may call for additional information from the applicants as the Legal Education Committee may deem necessary.
16. Conditions for a University to affiliate a Centre of Legal Education
(2) After affiliation order is received from the University the Centres of Legal Education may only then apply for inspection by the Bar Council of India.”

Learned counsel for the petitioner submits that petitioner has repeatedly represented the matter before Bar Council of India and last representation was made by petitioner on 31.01.2026. He submits that Secretary, Bar Council of India may be directed to take decision on that representation.
8. Mr. Sandeep Tewari, appearing for Bar Council of India submits that he has no objection if the writ petition is disposed of in terms of the prayer

9. The writ petition is, accordingly, disposed of with direction to the Secretary, Bar Council of India to take decision on the representation made by petitioner within eight weeks from date of presentation of certified copy of this order.
10. This Court hopes and expects that Kumaon University shall also bear in mind Rule 15 and 16 of the Rules of Legal Education, 2008 while granting affiliation. It shall be open to the petitioner to seek waiver of late fee.
