The writ application has been preferred praying for recovery of gratuity under Section 8 of the Payment of Gratuity Act, 1972, amounting to Rs.3,86,206/- along with applicable interest in favour of the petitioner, as per the order of the Controlling Authority. 2. It is further stated that necessary direction be given to the Certificate Officer for completion of the certificate proceeding expeditiously within a specific period. 3. It appears that the certificate proceeding in the present case was initiated in June, 2025. 4. As per the report submitted through the learned counsel for the State, it appears that the Certificate Officer has been proceeding in accordance with law since then and has issued warrant of arrest on 05.01.2026. Order of 2 attachment of bank account vide order dated 13.01.2026 has also been passed. 5. As such, it appears that Certificate Officer is proceeding in accordance with law and this Court finds no reason to prima facie hold that the proceeding is not being conducted diligently. 6. Let the report filed by the State be kept with the record. 7. Learned counsel for the State has also filed a copy of the demand draft showing payment of Rs.30,000/- towards the Gratuity amount due to the petitioner. 8. Considering all these facts, the writ application is disposed of with the direction that that Certificate Officer shall make all endeavour to dispose of the case expeditiously, in accordance with law. 9. WPA 117 of 2026 is accordingly disposed of. 10. There will be no order as to costs. 11. Connected application, if any, stands disposed of. 12. Interim order, if any, stands vacated. 13. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Shampa Dutt (Paul), J.)
