4. Petitioner’s land situate at Mauja Baheri Rajputana, Tehsil Roorkee, District Haridwar was acquired pursuant to notification dated 28.06.2021, issued by National Highway Authority of India.
5. According to petitioner, he was dissatisfied with the amount determined as compensation by Competent Authority, Land Acquisition, vide order dated 20.05.2022, therefore, he approached the Collector under Section 3G(5) of National Highways Act, 1956.
6. Since the Collector has not taken decision on petitioner’s application, therefore, he has approached this Court seeking the following relief:-
“i) Issue a suitable writ, order or direction to expedite the disposal of Arbitration Case No. 628 of 2023 "Bhumesh Kumar Agarwal vs The Ministry of Road Transport and Highways and another" filed by the petitioners under section 3(G) (5) of The National Highways Laws (Amendment) Act, 1997 against the adjudication/ award passed by the Special Land Acquisition Officer or Competent Authority whereby the Special Land Acquisition Officer or
2026:UHC:4552 Competent Authority has acquired the land of petitioners situated in khasra no. 1158 measuring 50.86 square meter, khasra no. 1159 measuring 50 square meter, khasra no. 1161 measuring 40 square meter, 1162 measuring 260 square meter situated at Mauja Badhedi Rajputan Pargana Roorkee, Tehsil Roorkee District Hardiwar which is pending since 04.08.2023 (contained as Annexure no. 2 at page no. 24 to 36).”

Learned counsel for the petitioner submits that application before the Collector under Section 3G(5) was moved on 04.08.2023. Thus, he submits that nearly three years have elapsed, yet Collector has not taken any decision in the matter. He submits that Collector/Arbitrator be
directed to expedite hearing of the said application.

Learned counsel for the respondents submit that they have no objection, if suitable direction is issued to the competent authority.
9. The writ petition is, accordingly,
disposed of with direction to the Collector/ Arbitrator, Haridwar to take decision on the application moved by petitioner under Section3G(5) of National Highway Act, 1956, as per law, within six months from date of presentation of certified copy of this order before him.
