ORDER:
The writ petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“…to issue a direction or order or writ, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in seeking to interfere with the petitioners' ownership, possession, occupation and enjoyment of their property admeasuring Ac. 201-17 cents, forming part of Sy. Nos. 1599, 1600, 1601, 1602, 1603, 1604, 1606, 1607, 1609, 1610, 1611, 1612, 1613, 1614, 1615, 1617, 1618, 1619, 1620, 1622, 1623, 1624, 1625, 1627 and 1629 part, situated at Chintakommadinne village and mandal, Y.S.R. (Kadapa) district, Andhra Pradesh, by seeking to proceed with a purported enquiry pursuant to the notice dated 07.07.2026 bearing Ref. No. A / 112 / 2025 issued by the respondent No. 4, without disclosing the nature and scope of the proposed enquiry, the allegations or material sought to be relied upon, or the case which the petitioners are required to meet, and in patent contravention of the binding directions issued by this Court, as being wholly arbitrary, illegal, unconstitutional, and in gross violation of the fundamental and constitutional rights of the petitioners, besides being in direct contravention of the law laid down by this Court and the Supreme Court of India, and in gross violation of the principles of natural justice and set aside all such actions including the notice dated 07.07.2026 bearing Ref. No. A / 112 / 2025 issued by the respondent No. 4 and pass such…”

The case of the petitioners is mainly that the order of this High Court in W.P. No. 13968 of 2025, dated 05.01.2026 had not been

complied while issuing the notice dated 07.07.2026 served on the petitioners on 16.07.2026 as the case supposed to be answered by the petitioner was not mentioned and the notice was not accompanied by the enquiry report dated 08.04.2025 which was specifically ordered to be supplied. 3. The learned Government Pleader for Revenue placed on record a copy of written instructions of the respondent No. 4, dated 21.07.2026 wherein it was mentioned that the enquiry report had been furnished to the petitioners as ordered by this Court in W.P. No. 13968 of 2025, dated 05.01.2026, however, the petitioners, instead of availing the opportunity of placing their objections before the competent authority, had deliberately approached this Court, suppressing the material facts. 4. The learned counsel for the petitioners produced before this Court two registered covers received by the petitioners, out of which one was opened, but the other is not opened, and submitted that the opened cover does not contain the enquiry report and if the respondents request, the closed cover also will be opened then and here to indicate that the report was not enclosed to the notice. Claiming that since the notice was not accompanied by the enquiry report, he requested to pass an appropriate order. 5. In reply, learned Government Pleader for Revenue submitted that due process will be followed by the respondents to comply the order of this Court in W.P. No. 13968 of 2025, dated 05.01.2026 by issuing a fresh notice. 6. Accordingly, the writ petition is allowed. The impugned notice vide Ref. No. A / 112 / 2025, dated 07.07.2026 is set aside. It is made clear that the respondents are at liberty to issue a fresh notice by duly complying the order in W.P. No. 13968 of 2025, dated 05.01.2026. 4 BSB,J W.P.No.19960 of 2026
