Heard Mr. D Das, the learned Senior Counsel, assisted by Mr. R Sarma, the
learned counsel appearing on behalf of the applicants. Mr. M Goswami, the learned Senior Counsel, assisted by Mr. R Choudhury, the learned counsel appearing on behalf of the writ petitioner and Mr. P Baruah, the learned counsel who appears on behalf of the ONGC.
2. This is an application filed by the applicants seeking the leave of this Court to be impleaded as respondents to the accompanying writ petition.
3. This Court has duly taken note of the cause of action for which the accompanying writ petition has been filed as well as the relief which has been
Page No.# 3/3 sought for by the writ petitioner.
4. It is also seen that the change of the Bank Account number which has been challenged by the petitioner is on account of the intervention by the applicants. In addition to that, the petitioner has also sought for a relief that the ONGC should proceed with the terms and conditions of the agreement entered into by and between the petitioner along with the ONGC without the interference of the third party i.e the applicants herein.
5. Considering the above, it is, therefore, the opinion of this Court that the applicants herein are necessary parties to the accompanying writ petition. Accordingly, this Court, therefore, impleads the applicant Nos. 1 and 2 as the respondent Nos.3 and 4 to the accompanying writ petition.
6. The learned counsel appearing on behalf of the petitioner is directed to file a fresh memo of parties before the Registry of this Court and the Registry shall on the basis of the fresh memo of parties along with the instant order make the necessary corrections in the cause-title of the accompanying writ petition as well as update the same in the CIS.
7. Interlocutory application accordingly stands disposed of.
