( 2026:MNHC:142 ) WP(C) No. 552 of 2026 Page 3 (O R D E R) [1] Mr. Rendy M., learned counsel appeared on behalf of the petitioners (four in number), Mr. Shyam Sharma, learned GA appeared on behalf of the respondent nos. 1, 2, 3 & 4, and Mr. W. Darakishwor, learned Sr. PCCG appeared on behalf of the respondent no. 7. In view of the limited prayer made on behalf of the petitioners and as agreed to by all the learned counsel appearing for the parties, the present writ petition is being disposed of at the motion stage. [2] At the outset, the learned counsel appearing for the petitioners submitted that the present writ petition has been filed with a prayer for issuing a direction to the respondents to release the balance amount of the award due payable to the petitioners pursuant to the award for compensation passed by the Deputy Commissioner (DC)/Competent Authority of Land Acquisition (CALA), Ukhrul District. [3] The learned counsel appearing for the petitioners submitted that for redressing the grievances raise by the petitioners in the present writ petition, they have already approached the DC/CALA, Ukhrul District by submitting 4 separate ( 2026:MNHC:142 ) WP(C) No. 552 of 2026 Page 4 representations all dated 30.10.2024 and that the said representations are still pending for consideration and disposal. The learned counsel, accordingly submitted that the petitioners will be satisfied for the time being if the present writ petition is disposed of by directing the DC/CALA, Ukhrul District (Respondent no. 2) to consider the said 4 representations submitted by the petitioners on its own merit and strictly in terms of the applicable act and rule and to dispose of the same by passing an appropriate order within a stipulated period. [4] Mr. Shyam Sharma, learned GA representing the respondent no. 2 fairly submitted that as the prayer made on behalf of the petitioners is confined to consideration and disposal of the representations submitted by them, he has no objection in disposing of this writ petition as prayed for. [5] Considering the submission made by the learned counsel appearing for the parties and the limited prayer made on behalf of the petitioners, this Court is of the considered view that it will serve the interest of justice to issue the following directions; (i) The DC/CALA, Ukhrul District is hereby directed to consider the aforesaid 4 separate representations file by the petitioners all dated 30.10.2024 on its own merit and strictly in ( 2026:MNHC:142 ) WP(C) No. 552 of 2026 Page 5 terms of the applicable law and to dispose of the same by issuing appropriate order. (ii) The consideration and disposal of all the said representations should be completed within a period of 3 months from the date of receipt of certified copy of this order. (iii) The respondent no. 2 is further directed to communicate to all the petitioners about any order pass by him in connection with the said representations within a period of 2(two) weeks from the date of passing such an order. (iv) It is made clear that the aforesaid directions have been issued on the consent of all the learned counsel appearing for the parties and without touching upon the merit of the present writ petition.
