JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER The captioned petition is filed seeking a writ of mandamus directing the respondent-authorities to consider the petitioners’ representation dated 21.02.2026 (Annexure-A) and to grant permission to the petitioners to conduct seasonal business by putting up stalls during the period of the Ramadan festival. 2. This Court had earlier directed the learned Standing Counsel appearing for the BBMP to obtain instructions as to whether the open space presently being utilised as a parking area could be temporarily diverted for a few days so as to enable the petitioners and other small vendors to put up stalls for sale of food items during the Ramadan fasting period. 3. Pursuant to the said direction, the Assistant Executive Engineer of BBMP and the Inspector of Shivajinagar Police Station are present before the Court. On being queried by this Court, both the officials have expressed serious reservations - 7 - HC-KAR NC: 2026:KHC:14887 WP No. 7201 of 2026 regarding diversion of the said parking space for installation of stalls till the completion of Ramadan. It is stated that the said open area is presently used for parking of both four-wheelers and two-wheelers and its diversion would aggravate the already existing traffic congestion in the locality, thereby causing inconvenience to the general public. The Inspector of Shivajinagar Police Station has also specifically submitted that permitting stalls at the said location at this juncture is not feasible in view of the traffic management issues. Photographs have also been produced before the Court demonstrating that the said area is presently being used as a parking lot. 4. On perusal of the photographs and in view of the submissions made by the concerned officials, this Court is of the opinion that the present case does not warrant exercise of discretionary jurisdiction under Article 226 of the Constitution of India to issue the directions sought for. While this Court is conscious of the fact that the month of Ramadan is an auspicious occasion and that the petitioners are small vendors who depend upon such seasonal business for their livelihood, the Court cannot lose sight of the larger public interest and the - 8 - HC-KAR NC: 2026:KHC:14887 WP No. 7201 of 2026 practical difficulties expressed by the civic and police authorities. In the circumstances, the request made in the representation cannot be acceded to. For the aforesaid reasons, the writ petition stands dismissed.
