2026:UHC:4554 SL. No. Date Office Notes, reports, orders or proceedings or directions and Registrar’s order with Signatures COURT’S OR JUDGE’S ORDERS WPMS/1727/2026 Hon’ble Manoj Kumar Tiwari, J. Mr. B.S. Koranga, Advocate for the petitioner. 2. Mr. Yogesh Pandey, Deputy Advocate General with Ms. Swati Verma & Mr. P.S. Bisht, Brief Holder for the State/respondent nos. 1, 3 & 4. 3. Mr. H.M. Bhatia and Mr. Rahul Consul, Advocate for respondent no. 2. 4. Petitioner’s brother (Manoj Kumar) was registered as construction worker with Uttarakhand Building and other Construction Workers Welfare Board. Petitioner’s brother reportedly passed away on 14.07.2025. By means of this writ petition, petitioner has sought the following relief:- “i) To issue a writ order and direction in the nature of Mandamus directing and commanding the Respondents to consider the case of the petitioner for releasing Rs/- 30,0000/- in favour of the petitioner under the Building and other construction workmen (Regulation of employment and conditions of service) scheme without any technical objection.” 5. It is contended by learned counsel for the petitioner that as per the scheme, in case of death of a construction worker, financial assistance is to be given to the dependent family members. He submits that benefit of that scheme has not been given to petitioner earlier. 2026:UHC:4554 6. Learned counsel for the Board, however, submit that under the scheme, benefit has to be given to a dependent family member and petitioner does not appear to be dependent upon his brother, therefore, the rightful claimant would be the father (Mr. Subhash Chandra) of the petitioner. 7. Having regard to the facts and circumstances of the case, the writ petition is disposed of with liberty to the rightful claimant/dependent of Manoj Kumar to apply for financial assistance under the scheme applicable to the registered workers. If such application is made within three weeks, decision thereupon shall be taken by the competent authority in the Board, as per law, within six weeks thereafter.
