02/17.04.2026 Heard learned counsel for the petitioner and learned A.P.P for the State.
2. The petitioner is apprehending his arrest in connection with Garhwa Town P.S. Case No.383 of 2024, for offence registered under Sections 191(2), 191(3), 190, 109, 132, 121(1), 115(2), 324(4), 285, 221, 223, 224, 125, 326(f) of BNS, 2023 and Section 3 of Prevention of Damage to Public Property Act, pending in court of learned Chief Judicial Magistrate, Garhwa.

Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the FIR and there are eight named accused persons and said accused persons had taken name of ten other persons. He further submits that there are general and omnibus allegations of pelting stone upon the police force as the agitation was going on due to road accident in which two children of public school have died. He then submits that the petitioner was crossing from the place of occurrence and in view of hooliganism, he has run away. He then submits that the petitioner has got no criminal antecedent as disclosed in paragraph no.12. He also submits that other co-accused persons have been granted anticipatory bail in A.B.A. No.5618 of 2024, A.B.A. No.5898 of 2024, A.B.A. No.7316 of 2024, A.B.A. No.75 of 2025, A.B.A. No.1883 of 2025, A.B.A. No.2283 of 2025, A.B.A. No.2955 of 2025 and A.B.A. No.6227 of
2025.
4. Learned A.P.P. appearing for the State has opposed the prayer and submits that allegations are there against the petitioner of pelting stones.
5. Considering that other co-accused persons have been granted anticipatory bail in aforesaid A.B.As. and there is general and omnibus allegation of pelting stones upon the police force and the petitioner is not
2026:JHHC:11055 named in the FIR and what has been argued by the learned counsel for the petitioner, in such a situation, that cannot be ruled out, and in the attending facts and circumstances of the present case, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Garhwa, in connection with Garhwa Town PS Case No.383 of 2024, subject to the conditions as laid down under Section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
