For the Respondent : Mr. Aditee Dongrawat, AC to G.P-V ------- 17/Dated:07.04.2026 The instant application has been preferred by the petitioner for the following relief:- (a) for issuance of an appropriate writ(s), order(s) or direction(s) in the nature of mandamus commanding upon the respondents to immediately and forthwith to consider the case of the petitioner for regularisation of his service as a Driver on which post he has been working since his appointment made on 13.10.2010 against sanctioned and vacant post of Driver as permanent. 2026:JHHC:9923 2 (b) for issuance of a further appropriate writ(s), order(s) or direction(s) in the nature of mandamus commanding upon the respondents to immediately and forthwith make payment of salary to the petitioner which has been withheld from November, 2021 to till date due to which the petitioner is suffering extreme financial crisis. 2. Ld. Counsel for the petitioner submits that though he has been working on the post of Driver continuously; since 13.10.2010, but till date he has not been regularized. Further, he has also not received payment of salary which has been withheld from November 2021 till date. 3. Ld. State Counsel submits that the case of the petitioner for regularization has been rejected; as such, he may challenge the same, as the same is new cause of action. 4. Having regard to the factual scenario, the instant writ application stands disposed of by giving liberty to the petitioner to challenge the order rejecting his claim for regularization in a fresh writ application as the same is fresh cause of action. So far as issue of unpaid salary is concerned; the petitioner is further at liberty to approach the respondent no.6 making a detail representation with regard to his salary for the concerned period as prayed in the instant writ application within a period of Six Weeks. 2026:JHHC:9923 3 5. The moment the said representation will be received by the 6th respondent, he shall look into the matter and after verification of records pass an appropriate order, and, if any amount is found payable; then the same shall be paid to the petitioner. The entire exercise shall be completed within a period of 12 weeks from date of receipt of the representation. 5.
