The writ petition came to be dismissed as having been rendered infructuous on the statement made by the counsel earlier engaged by the appellant. However, the appellant appearing in person states that on the date when the statement had been made by the counsel earlier appointed by him, he had no authorization to make such a statement in view of the no objection having been given by the said counsel on 09.09.2025. 2 HCJ & RRR, J WA_427_2026 It was urged that the matter had in fact not been rendered infructuous and the issues were required to be decided on merits. 3. For the reasons above, we set aside the judgment and order impugned and restore the writ petition to its original number to be decided in accordance with law. 4. The Writ Appeal is, accordingly, allowed. No order as to costs. Registry is directed to list WP.No.26303 of 2024 before the appropriate Bench having Roster.
