The instant bail application under Section 483 B.N.S.S. has been filed by the petitioner in connection with the FIR No. 277/2022 registered at Police Station Mahaveer Nagar, District Kota City wherein he was charged for the offences punishable under Sections 420, 406 and 120-B IPC. 2. Counsel for the petitioner submits that the allegations levelled against the petitioner and the co-accused Maina Devi are identical and similar and indulgence of bail has been granted to her by the Co-ordinate Bench of this Court in S.B. Criminal Misc. Bail Application No. 14724/2025 on 25.11.2025. Counsel submits that the petitioner is merely a broker, who deals in share market and mutual funds etc. Counsel submits that as per the allegations levelled by the complainant, the petitioner and the co-accused (2 of 3) [CRLMB-551/2026] abetted the complainant to invest certain amounts in mutual funds and in share market etc. and at their instance huge amount consisting lacks of rupees were invested but appropriate benefits were not granted to him. Counsel submits that the petitioner and the co-accused have not been given appropriate amount to the complainant rather certain cheques have been issued by them in favour of the complainant to return certain part of the amount. Counsel submits that the petitioner is in custody since 07.05.2025. Counsel submits that trial will take its own time to conclude, therefore indulgence of bail be granted to the petitioner. 3. Per contra, learned Public Prosecutor opposed the bail application. 4 Heard and considered the submissions made at Bar and perused the material available on record. 5. Considering the arguments put forward by learned counsel for the petitioner and looking to the fact that the allegations against the petitioner and the co-accused-Maina Devi are identical and indulgence of bail has already been granted to her and also looking to the fact that the alleged offences are triable by the Magistrate and considering that the petitioner is in custody since 07.05.2025 and trial will take its own time to conclude, without expressing any opinion on merits and demerits of the case, this Court deems it just and appropriate to grant indulgence of bail to the petitioner under Section 483 BNSS. 6. Accordingly, this bail application under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioner-Pawan Jain S/o Padam Kumar Jain arrested in connection with the aforementioned FIR, may be released on bail; provided he (3 of 3) [CRLMB-551/2026] furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
